Terms of Use

1. TERMS AND CONDITIONS OF SALE

Last updated: [date] | Version 1.0

1.1 Who we are

These terms apply to purchases from tridyl.com. Tridyl is a trading name of Guadit Ltd ("we", "us", "our"), a company registered in England and Wales, company number [number], registered office [address]. Contact: contact@tridyl.co.uk, [phone].

1.2 Who these terms are for

These terms apply to consumers (individuals buying for purposes mostly outside their trade, business or profession). By placing an order you confirm you are 18 or over and are buying for yourself or as a gift.

1.3 Information we give you before you order

Before you pay, our website shows you: the main features of the goods; the total price including VAT (where applicable) and delivery charges; our identity and contact details; how and when we will deliver; your right to cancel and how to use it; and the legal guarantee that goods must match their description and be of satisfactory quality. Please read these terms and our Returns, Refunds and Cancellation Policy before ordering.

1.4 Making a contract

  1. Placing an order is an offer to buy. After you click "Place order" (the button clearly states you are obliged to pay), we send an order acknowledgement email. This is not acceptance.

  2. A binding contract is formed when we send an order confirmation.

  3. If we cannot accept your order (for example, item out of stock, pricing error, failed payment or fraud check), we will tell you promptly and refund anything you have paid.

  4. Please check your order carefully before submitting. You can correct input errors by editing your basket or contacting us before dispatch.

1.5 Pricing and payment

  1. Prices are in pounds sterling (£) and show the total including VAT where applicable. Delivery costs are shown before you pay. There are no hidden fees.

  2. If we discover a genuine pricing error, we will contact you before dispatch. You can choose to confirm the order at the correct price or cancel for a full refund. We will not hold you to an obvious mistake (for example, a £0.99 item that should be £99).

  3. We accept Visa, Mastercard, PayPal, Apple Pay, Google Pay etc. Payment is taken when you place your order or for pre-orders: at the time stated on the product page.

  4. Payments are processed by Stripe and Paypal. We never see or store your full card details.

  5. We may carry out fraud checks. We may cancel and refund an order if we reasonably suspect fraud.

1.6 Delivery

Delivery is governed by our Delivery Policy. Unless we agree a different date, we will deliver within 30 days of the contract being made. Risk in the goods passes to you when they are delivered to you. You own the goods when we receive full payment.

1.7 Your right to cancel (the 14-day "cooling off" right)

You have the right to cancel most orders within 14 days of receiving your goods, without giving a reason. Full details, exceptions and a model cancellation form are in our Returns, Refunds and Cancellation Policy.

1.8 Your legal rights if goods are faulty

Under the Consumer Rights Act 2015, goods must be as described, of satisfactory quality and fit for purpose. Nothing in these terms affects your statutory rights. See the faulty goods section of our Returns, Refunds and Cancellation Policy.

1.9 Personalized, made-to-order and pre-order items

Personalized or made-to-order goods are made to your specification and are not eligible for the 14-day cancellation right (but you keep your statutory rights if they are faulty or not as described). Pre-order items will show an expected dispatch date. If we cannot meet it, we will tell you and you may cancel for a full refund.

1.10 Product information, colours and sizes

We try to describe and photograph products accurately. Screens vary, so colours may differ slightly. Sizes and weights are approximate unless stated. Products are for normal domestic use only.

1.11 Age-restricted and safety information

Baby, toy, party and electrical products must be used as directed and in line with age warnings on the packaging and our product pages. See our Product Safety and Recalls Policy.

1.12 Our responsibility to you

  1. We are responsible for foreseeable loss or damage you suffer because we break these terms or fail to use reasonable care and skill. We are not responsible for loss that is not foreseeable.

  2. We do not exclude or limit liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or for anything else that cannot legally be excluded.

  3. We only supply goods for domestic and private use. We are not liable for loss of profit or business loss.

1.13 Events outside our control

We are not liable for delay or failure caused by events outside our reasonable control (for example severe weather, strikes, courier network failure, supplier failure, pandemic, war). We will tell you promptly. If the delay is long more than 30 days you may cancel and we will refund you.

1.14 Your personal data

See our Privacy Policy and Cookie Policy

1.15 Intellectual property

All content on tridyl.co.uk (text, images, logos, design) belongs to us or our licensors. You may not copy or reuse it commercially without written permission.

1.16 Changes to these terms

The terms in force when you order are the ones that apply to that order. We may update future terms.

1.17 Complaints and dispute resolution

See our Complaints Procedure. If we cannot resolve a complaint, You can also seek advice from Citizens Advice (consumer helpline 0808 223 1133). You can also go to court at any time.

1.18 Law and jurisdiction

These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you may bring claims in your local courts and local mandatory consumer laws still apply to you.

1.19 General

If any part of these terms is found unenforceable, the rest remains in force. If we delay enforcing a term, we can still enforce it later. No third party has rights to enforce these terms.

2. RETURNS, REFUNDS AND CANCELLATION POLICY

Last updated: [date]

2.1 Summary (shown near the top)

  • You can cancel most orders within 14 days of receiving them, and then have another 14 days to send them back after telling us.

  • Faulty or wrongly described goods: free return, full refund, replacement or repair, with your legal rights unaffected.

  • Refunds go to your original payment method within 14 days of us receiving your return (or proof of postage).

2.2 Your statutory right to cancel (Consumer Contracts Regulations 2013)

  1. You may cancel an order for goods without giving a reason from the day you place the order until 14 days after the day you receive the goods.

  2. To cancel, tell us clearly by email to contact@tridyl.co.uk or using the returns form. You do not have to use the form, but you must make the decision to cancel clear. Please include your name, order number and the items.

  3. You must send the goods back to us within 14 days of telling us you are cancelling.

2.3 Condition of returned goods

Please return items unused, in original packaging, with all tags/labels/accessories and take reasonable care of them until we receive them. You are expected to take reasonable care of goods prior to return. In the event that goods are returned with damage, the company reserves the right to apply a refund deduction. This deduction will be directly proportional to the extent of the damage and the market cost of replacement parts or restoration.

2.4 Who pays for returns?

You pay the direct cost of returning goods under your statutory right to cancel. We recommend using a tracked service as you are responsible for goods until they reach us.

If goods are faulty, damaged or not as described, we pay the reasonable cost of return, regardless of option.

2.4b Goods that are NOT eligible for the 14-day cancellation right

The law says these cannot be cancelled once ordered (you still keep your faulty-goods rights):

  • Goods made to your specification or clearly personalized (e.g. personalized items, printed party items).

  • Sealed goods not suitable for return for health or hygiene reasons once the seal is broken after delivery (for example pierced-ear jewellery, dummies/pacifiers, bottle teats, breast pumps parts, swimwear with hygiene liner, cosmetics, open-package underwear). Products affected will be marked on the product page.

  • Goods that after delivery are inseparably mixed with other items.

  • Gift cards: see Gift Card Terms; unused cards are non-refundable.

2.5 Refunds

  1. We refund the price you paid plus the cost of standard delivery. Extra cost for a premium delivery option you chose is not refunded.

  2. We refund within 14 days of the day we receive the goods back. For orders you cancel before dispatch, we refund within 14 days of your cancellation.

  3. We use the same payment method you used to pay unless you agree otherwise. There is no fee for refunds. Your bank/card provider may take a few extra days to show it.

  4. If you partly cancel (some items out of an order), we refund those items only.

2.5b Wrong, missing or damaged-in-transit items

Contact us within 14 days with your order number and photos. We will refund at no cost. Risk of damage stays with us until delivery.

2.6 Faulty goods and your legal rights (Consumer Rights Act 2015)

This is separate from the 14-day cancellation right and cannot be limited by us.

  1. Within 30 days of delivery, if goods are faulty, not as described, or not fit for purpose, you may reject them for a full refund (you do not have to accept a repair or replacement).

  2. After 30 days and within 6 months, you may ask for a repair or replacement. If that fails or is not possible within a reasonable time without significant inconvenience, you may ask for a price reduction or final right to reject and a refund. In the first 6 months we presume the fault was there when delivered unless we can show otherwise.

  3. After 6 months, you may still ask for a remedy (up to 6 years in England, Wales and Northern Ireland; 5 years in Scotland from delivery for durable goods) but you may need to show the fault was present at delivery, and any refund may take account of use.

  4. If we agree goods are faulty, we refund within 14 days of that agreement.

  5. We pay reasonable return costs for faulty items. Please contact us first at contact@tridyl.co.uk with your order number so we can arrange this.

  6. Fault claims do not cover fair wear and tear, misuse or accidents.

2.7 Exchanges

We do not offer direct exchanges. Please return the item for a refund and place a new order.

2.8 How to return

  1. Email Contact@tridyl.co.uk with your order number or use the returns form.

  2. Pack securely. Include your order number.

  3. Post to: Guadit Ltd t/a Tridyl Returns, [returns address].

  4. Keep your proof of postage. We cannot take responsibility for items lost on the way back to us unless we have arranged the collection.

  5. We email you once we receive the return and process the refund.

2.9 Sale items

Sale items have the same cancellation and faulty goods rights as full-price items.

If you have a privacy concern, contact:

Privacy@tridyl.co.uk

You may also complain to the Information Commissioner's Office (ICO).
